Welcome to VitaCal. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using VitaCal, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the app.
2. Description of Service
VitaCal is a nutrition and health tracking application that allows users to:
- Log meals and track calorie and macro intake
- Use AI-powered photo recognition to identify foods
- Set and monitor nutritional goals
- Track water consumption and weight
- View nutrition history and trends
- Connect Apple Health or Health Connect to import health data, and on Pro, write nutrition back out to it
- Ask VitaCal, an AI coach that answers questions about your own synced health data
- VitaCal Connect, an endpoint that lets an AI client you authorise read your health data over the Model Context Protocol
3. Account Registration
To use certain features of VitaCal, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for:
- Maintaining the confidentiality of your account
- All activities that occur under your account
- Notifying us immediately of any unauthorised use
4. Subscriptions and Payments
VitaCal offers premium features through subscription plans, and AI coach credits as one-off packs. Purchases are made through the App Store or Google Play and are tracked on our side by RevenueCat. By subscribing:
- You agree to pay the subscription fees displayed at the time of purchase
- Subscriptions automatically renew unless cancelled before the renewal date
- You can manage or cancel subscriptions through the App Store or Google Play
- Refunds are handled according to Apple's or Google's refund policies
- Credit packs are one-off purchases and the credits do not expire
5. User Conduct
You agree not to:
- Use the app for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the app
- Upload malicious content or interfere with the app's operation
- Share your account credentials with others
- Use automated systems to access the app
6. Health Disclaimer
VitaCal is not a medical device and does not provide medical advice.
- The nutritional information and recommendations provided are for informational purposes only
- AI-generated nutritional estimates may not be 100% accurate
- Always consult a healthcare professional before making significant dietary changes
- Do not use VitaCal as a substitute for professional medical advice, diagnosis, or treatment
- If you have a medical condition or eating disorder, consult your doctor before using this app
7. Intellectual Property
All content, features, and functionality of VitaCal are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
8. User Content
You retain ownership of the content you submit, such as meal photos, food logs and the health data you choose to sync. By submitting content, you grant us a non-exclusive license to use, process, and store it for the purpose of providing the service. A meal photo is an exception: it is uploaded only so it can be analysed, is deleted straight after, and is never attached to a saved meal.
9. Third-Party Services
VitaCal relies on the following third parties. Each receives only what it needs to do its job:
- Firebase (Google Cloud): authentication, database, file storage and the server functions the app calls. It holds your account, your logs and any health data you sync.
- Apple Sign-In and Google Sign-In: they confirm who you are and return an account identifier and your email address.
- Google Gemini: the AI model behind meal photo analysis and Ask VitaCal. It receives the meal photo you submit, and, for a coach question, the health data needed to answer it.
- RevenueCat: subscription and credit-pack purchase records. It receives your store purchase receipts and an app user identifier. Payment itself is handled by the App Store or Google Play.
- Anthropic (claude.ai and Claude Code): only if you set up VitaCal Connect. An MCP client you authorise can then read the health data that endpoint exposes.
Your use of these services is subject to their respective terms and privacy policies.
10. Limitation of Liability
To the maximum extent permitted by law:
- VitaCal is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim
- We are not responsible for any health outcomes resulting from use of the app
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the app or violation of these Terms.
12. Termination
We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the app settings or by contacting support.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms. We will notify you of significant changes via the app or email.
14. Governing Law
These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
